AAT Appeals

The Administrative Appeals Tribunal (AAT) handles independent merits review of administrative decisions made under Commonwealth laws.

WHAT ARE THE CHANCES OF SUCCESS?

An appeal from an AAT decision must be successful if the applicant can persuade the judge considering the case that the AAT made a legal error that affected the decision under appeal.

Errors of law might include:

  • Denying procedural fairness to a party; or
  • Incorrectly interpreting a statute relevant to the proceeding.

However, even when an error of law is demonstrated, the Judge may dismiss the appeal if he or she considers that the AAT arrived at a decision that was correct on the material before it.

The judge considering an appeal of an immigration case officer's ruling:

  • Does not take into account any new evidence or information not previously submitted in the case (except under specific conditions);
  • Does not call witnesses to testify;
  • Has perused every pertinent document that the parties in the initial case submitted;
  • Does hear the legal defenses made by each appeal party.
