What Is the Special Category Visa (Subclass 444)?

The Special Category visa (SCV) is the visa generally granted to eligible New Zealand citizens when they enter Australia.

New Zealand citizens with a valid New Zealand passport generally do not need to apply for an Australian visa before travelling to Australia. If they meet the SCV requirements, the SCV can be granted when they enter Australia.

The SCV allows eligible New Zealand citizens to live, study and work in Australia.

Direct Pathway to Australian Citizenship

One of the most important changes occurred on 1 July 2023.

Eligible New Zealand citizens holding an SCV can apply directly for Australian citizenship by conferral.

You do not have to first obtain a permanent visa solely to become eligible to apply for citizenship under this pathway.

New Zealand citizens holding an SCV are treated as permanent residents for Australian citizenship purposes, subject to the applicable citizenship requirements.

Who May Be Eligible?

You may be able to use the New Zealand citizen pathway if you:

• Are a New Zealand citizen
• Hold a valid Special Category visa (subclass 444), where applicable
• Meet the Australian citizenship residence requirements
• Meet the relevant identity requirements
• Satisfy the character requirements
• Meet the citizenship requirements applicable to your age and circumstances
• Intend to live in Australia or maintain a lasting connection with Australia where required

Holding an SCV by itself does not automatically mean that you are eligible for Australian citizenship.

Your complete immigration and residence history should be assessed before applying.

Australian Citizenship Residence Requirement

For the general residence requirement, you must normally have:

• Lived in Australia on a valid visa for the 4 years immediately before applying
• Held a permanent visa or SCV during the 12 months immediately before applying
• Not been outside Australia for more than 12 months in total during the previous 4 years
• Not been outside Australia for more than 90 days during the 12 months immediately before applying

There can be special rules and exceptions in particular circumstances.

Special Rules for New Zealand Citizens

Special rules apply when determining the permanent residence commencement date for certain New Zealand citizens holding an SCV.

For citizenship purposes:

• If your SCV was granted before 1 July 2022, you are generally treated as a permanent resident from 1 July 2022.
• If you were granted your first SCV on or after 1 July 2022, you are generally treated as a permanent resident from the date that SCV was granted.

These rules can be important when calculating citizenship eligibility.

Your individual travel and visa history should be checked rather than relying solely on the date you first arrived in Australia.

Do You Need to Apply for Permanent Residence First?

Not necessarily.

For eligible New Zealand citizens holding an SCV, the current pathway allows a direct application for Australian citizenship by conferral.

You therefore do not need to obtain a separate permanent visa before applying for citizenship solely because you are a New Zealand citizen with an SCV.

However, permanent residence may still be relevant for some people depending on their circumstances, family plans and future migration options.

New Zealand Stream Subclass 189

The New Zealand stream of the Skilled Independent visa (subclass 189) is no longer open to new primary applicants.

The New Zealand stream permanently closed to new applications from 1 July 2023 following the introduction of the direct citizenship pathway. Existing applications made before closure continue to be processed under the applicable arrangements.

This means eligible New Zealand citizens should generally consider the current citizenship pathway rather than assuming that a new subclass 189 New Zealand stream application can be lodged.

New Zealand Citizens and Australian Citizenship

If you meet the citizenship requirements, you can apply for Australian citizenship by conferral.

The citizenship process may involve:

1. Checking your eligibility
2. Calculating your Australian residence
3. Preparing identity and supporting documents
4. Lodging the citizenship application
5. Completing the citizenship test where applicable

What About Family Members?

The pathway for a New Zealand citizen does not automatically give every family member Australian citizenship.

The circumstances of the parent at the time of the child's birth and the relevant residence and visa history are important.

The Department states that, following the 2023 changes, certain children born in Australia on or after 1 July 2022 to eligible SCV holders may automatically acquire Australian citizenship at birth.

Parents should check the child's citizenship status rather than assuming that a separate visa is required.
