Key Eligibility Guidelines for Subclass 449
The Department of Home Affairs provides temporary humanitarian relief for Iranian nationals currently in Australia who are unable to return home due to ongoing conflict and cannot qualify for standard visa pathways. Eligible individuals may be considered for a Humanitarian Stay (Temporary) visa (Subclass 449), provided they meet all mandatory health, character, and security clearances. Key Eligibility Guidelines for Subclass 449 The Subclass 449 visa operates on an invitation-only basis and cannot be directly applied for. Consideration for an offer typically applies to individuals who meet the following conditions: Location & Nationality: You must be physically present in Australia and hold Iranian nationality (or be an immediate family member of an Iranian national). Inability to Return: You cannot safely return to your usual place of residence and possess no legal right of residency in another country. Visa Expiration Timeline: Your current visa has already ceased, or it is scheduled to expire within the next three months. Lack of Alternatives: You must not have any active substantive visa applications in progress (including bridging visas linked to merits review) and must have exhausted all other standard visa options. In rare cases where these baseline criteria are not fully met, offers may still be evaluated under strict exceptional circumstances, provided there are no other viable pathways to remain lawfully in Australia or depart safely.
